Terms and Conditions

Definitions

For the purposes of these Terms of Use:

a. “User” / “You” / “Your”
Refers to any individual, organization, or entity that registers on or uses the Platform.

b. “Company” / “We” / “Us” / “Our”
Refers to Tegmotec Private Limited, operating under the brand name “Sweet Home”, including its successors and permitted partners.

c. “Platform”
Refers to the Company’s mobile applications, website, and related software and services.

d. “Services”
Refers to all features and functionalities provided through the Platform, including visitor management, society administration, communication tools, and other related services.

1. Acceptance of Terms and Account Creation

a. Acceptance of Terms
These Terms and Conditions (“T&C”) form a binding agreement between you and Tegmotec Private Limited (“Company”), which operates the SweetHome Platform. By accessing, registering, installing, or using the Platform, you agree to comply with these T&C, as updated from time to time.

b. Eligibility
You must be at least 18 years old to use the Platform. If you are under 18, you may use the Platform only with the consent and supervision of a parent or legal guardian.

c. Use on Behalf of an Entity
If you use the Platform on behalf of a housing society, association, or any organization (“Entity”), you confirm that:
• You are authorized to act on behalf of that Entity
• The Entity agrees to be bound by these T&C

d. Account Information
You agree to provide accurate and complete information during registration and to keep it updated. You are responsible for any issues that arise due to incorrect or outdated information.

e. Registration Requirement
To access certain features, you must register an account using the required details. You may update your information as needed through the Platform.

f. Account Suspension or Termination
We may suspend or terminate your account if:
• Your information is false, incomplete, or outdated
• You violate these Terms

g. Personal Use Only
The Platform is intended for personal, non-commercial use. Unauthorized commercial use is not allowed.

h. Communication Consent
By registering with your mobile number, you agree to receive:
• Service-related calls, messages, and notifications
• Important updates about your account or community
Promotional communications will be sent only where permitted by law, and you can opt out at any time.

i. Role of the Company
SweetHome is a technology platform that helps manage community activities. We do not:
• Hire or manage security personnel
• Perform background checks on security staff
• Control decisions related to hiring or management of such personnel
All such responsibilities lie with the respective housing society or Entity.

2. Administrator Account

a. Administrator Registration
If you register as an administrator (“Admin”) for a society, you may be required to complete a verification process. This may include creating and validating the society on the Platform.

b. Admin Access and Responsibilities
Once approved, the Admin will have access to manage society-related information and activities through the Platform. This may include access to certain data of other Users within the same society, as required for administration purposes.

c. Responsibility for Account Use
The Admin is responsible for:
• Maintaining the security of their login credentials
• Ensuring that access to the admin account is not misused
• Using the Platform in accordance with these Terms and applicable laws
The Admin and/or the society are responsible for actions taken through the admin account.

d. Limitation of Liability
The Company is not responsible for misuse of data or unauthorized access resulting from:
• Compromised admin credentials
• Improper use of admin privileges
However, the Company will take reasonable measures to maintain the security of the Platform.

e. Suspension or Termination of Admin Access
We may suspend or revoke admin access if:
• There is misuse of the Platform
• These Terms are violated
• Required by law or for security reasons

3. Scope of Services

a. Nature of the Platform
SweetHome is a technology platform designed to help manage and improve safety, communication, and daily operations within residential communities. We provide tools and features to support these activities, but we do not guarantee complete or uninterrupted safety or security.

b. Use of Resident Information
To provide our services, users and societies may share certain information such as:
• Name
• Contact details
• Flat/unit information
• Vehicle details
This information is handled in accordance with our Privacy Policy.

c. Visitor Management
The Platform allows residents and societies to manage visitor entry, including service staff, guests, and delivery personnel. All visitor approvals or rejections are controlled by:
• The resident, or
• The society’s security personnel
The Company does not control or take responsibility for decisions related to visitor entry.

d. Optional Services
Some features or services available on the Platform may be optional. You may choose to use them at your discretion.

e. Changes to Services
We may update, modify, or discontinue features or services from time to time. While we aim to provide a smooth experience, we do not guarantee that the Platform will always be error-free or uninterrupted.

f. Third-Party and Society Content
The Platform may display information provided by:
• Societies or RWAs
• Other users
• Third parties (including advertisements)
We do not control or verify all such content. You should use your judgment before relying on it.

g. Disclaimer of Information Accuracy
Information available on the Platform is provided on an “as is” basis. We do not guarantee its accuracy, completeness, or reliability, especially where it is provided by third parties or users.

4. Prohibited Activities

While using the Platform, you agree not to:

a. Violation of Laws
Use the Platform for any activity that violates applicable laws or regulations.

b. Intellectual Property Violations
Upload or share content that infringes the rights of the Company or any third party, including copyrights, trademarks, or other proprietary rights.

c. Unauthorized Sharing of Personal Information
Share any private, confidential, or sensitive information of others without their consent.

d. Harmful or Offensive Content
Post or share content that is:
• Defamatory, abusive, or insulting
• Obscene, vulgar, or sexually explicit
• Offensive towards any individual or group based on religion, caste, community, or other grounds

e. Protection of Minors
Upload or share any content that harms, exploits, or endangers minors in any way.

f. False Information or Impersonation
Create fake accounts, impersonate others, or share false or misleading information.

g. Harassment or Threats
Engage in behavior that is threatening, abusive, harassing, or intended to harm others.

5. Intellectual Property

a. Ownership of the Platform
The Platform and all its content—including software, design, text, graphics, logos, and other materials (“Company Materials”)—are owned by or licensed to the Company.
You are granted a limited, non-exclusive, non-transferable, and revocable right to use the Platform for personal use, in accordance with these Terms.

b. Trademarks
All brand names, logos, and related marks used on the Platform are owned by the Company.
You may not use, copy, or reproduce them without prior written permission.

c. Restrictions on Use
You agree not to:
• Copy, reproduce, modify, or distribute any part of the Platform or Company Materials
• Use automated tools (such as bots or scripts) to extract or collect data
• Create derivative works or use the Platform content for commercial purposes without permission

d. Third-Party Content
Some content on the Platform (such as advertisements or external links) may belong to third parties.
Such content is subject to the rights and policies of the respective owners.

e. Reporting Infringement
If you believe your intellectual property rights have been violated on the Platform, you may contact us at: legal@sweethome.in.net
Please provide sufficient details so we can review and take appropriate action.

6. Use and Disclosure of Information

By using the Platform, you agree that we may collect, store, and use your information (“User Data”) in accordance with our Privacy Policy.

Your data may be used only for purposes related to providing and improving the Platform, and as required under applicable laws.

We will handle your information in line with our Privacy Policy.

Nothing in these Terms limits your rights under applicable data protection laws.

7. Security Measures

a. Our Security Measures
We use appropriate technical and organizational measures—such as encryption, access controls, and authentication systems—to protect user data and maintain the integrity of the Platform.
Your use of the Platform is subject to these Terms, our Privacy Policy, and any applicable guidelines.

b. Prohibited Actions
You agree not to:
  • Attempt to bypass or interfere with the Platform’s security features
  • Hack, reverse engineer, or disrupt the Platform
  • Access data or systems without authorization
c. Consequences of Misuse
Any misuse of the Platform’s security may result in:
  • Suspension or termination of your account
  • Legal action where required under applicable law

8. Third-Party Links and Services

The Platform may include links to third-party websites, applications, or services (“Third-Party Platforms”).

We do not control or endorse these Third-Party Platforms and are not responsible for their content, services, or practices.

If you choose to access or use any Third-Party Platform:
• You do so at your own discretion
• You are responsible for reviewing their terms and privacy policies

We are not liable for any loss or damage that may arise from your use of any Third-Party Platform, to the extent permitted by applicable law.

9. Account Suspension and Termination

a. Suspension or Termination of Account
We may suspend or terminate your account if:
• You violate these Terms, the Privacy Policy, or any applicable guidelines
• We reasonably suspect unlawful, fraudulent, abusive, or unauthorized activity
Where appropriate, we may provide notice before taking such action.

b. Effect of Suspension or Termination
If your account is suspended or terminated:
• You may lose access to the Platform and its features
• Certain data associated with your account may become unavailable or be deleted
We are not responsible for loss of data resulting from such actions, except where required by applicable law.

10. Duration and Termination

a. Duration of Terms
These Terms remain in effect as long as you use the Platform or maintain an account with us.

b. Account Closure by User
You may stop using the Platform at any time by deleting your account.
If you have paid for any subscriptions or services, fees are generally non-refundable unless otherwise stated or required by applicable law.

c. Termination by the Company
We may suspend or terminate your account if:
• You violate these Terms or the Privacy Policy
• You provide false or misleading information
• Your actions disrupt the Platform or affect other users

d. Compromised Accounts
If we reasonably believe your account has been compromised (e.g., unauthorized access or misuse), we may temporarily suspend or deactivate it to protect you and the Platform.

e. Effect of Termination
If your account is terminated:
• Access to the Platform may be restricted or removed
• Associated data may be deleted or become unavailable
We are not responsible for loss of data resulting from such actions, except where required by law.

11. General Provisions

a. Changes to the Platform
We may modify, suspend, or discontinue any part of the Platform at any time.
We will make reasonable efforts to inform users where appropriate. The Company is not liable for any impact resulting from such changes.

b. Assignment
You may not transfer your rights or obligations under these Terms without our prior written consent.
We may transfer our rights or obligations under these Terms, including in connection with a merger, acquisition, or business transfer.

c. Entire Agreement
These Terms, along with our Privacy Policy and other applicable policies, form the complete agreement between you and the Company.
They replace any previous agreements or understandings related to the Platform.

d. Waiver and Severability
If we do not enforce any part of these Terms, it does not mean we waive our rights.
If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

e. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Any disputes will be subject to the jurisdiction of the courts in Mumbai, India.

12. Disclaimer of Warranties and Limitation of Liability

a. Nature of the Platform
SweetHome is a technology platform that helps manage community activities. We do not own, manage, or control any residential society or its operations. All decisions related to security, visitor entry, and administration are handled by the respective society or residents.

b. No Warranties
The Platform and its services are provided on an "as is" and "as available" basis. We do not guarantee that:

  • The Platform will always be available, uninterrupted, or error-free
  • The information or services will meet your specific expectations

c. Security and Technical Risks
While we take reasonable measures to maintain security, we do not guarantee that the Platform will be free from viruses or other harmful components.

d. Service Availability
We are not responsible for any loss or inconvenience caused by:

  • Downtime or service interruptions
  • Technical failures or network issues

e. Responsibility of Societies
Where a society or association shares resident data with us, it is responsible for obtaining necessary consents from its members.

f. Third-Party Actions and Real-World Incidents
We are not responsible for:

  • Theft, security incidents, or unlawful activities within a society
  • Actions of residents, visitors, or third parties

g. Reliance on Information
Any reliance on information available on the Platform is at your own discretion.

h. Limitation of Liability
To the extent permitted by law, the Company will not be liable for any indirect, incidental, or consequential damages, including loss of data, profits, or business interruption. If the Company is found liable, the total liability will not exceed the amount paid by you for using the Platform.

i. No Professional Advice
The Platform does not provide legal or professional advice. Any information is for general purposes only.

13. Indemnification

a. User Responsibility
You agree to indemnify and hold the Company, its affiliates, employees, and partners harmless from any losses, claims, or expenses (including legal costs) arising from:

  • Your use of the Platform
  • Your violation of these Terms, the Privacy Policy, or applicable laws
  • Any content or information you share through the Platform
  • Any infringement of intellectual property or other rights caused by you

b. Exceptions
This obligation does not apply where the issue is directly caused by the Company’s fraud, gross negligence, or wilful misconduct.

c. Legal Defence
The Company may choose to take control of the defence of any such claim. In such cases, you agree to cooperate as reasonably required.

14. Grievance Redressal

In accordance with the Information Technology Act, 2000 and applicable rules, the details of the Grievance Officer are as follows:

The Grievance Officer is responsible for handling user complaints and concerns related to the Platform.
We will:

  • Acknowledge your complaint within 24 hours
  • Resolve it within 15 days from the date of receipt, or as required under applicable law.
